These Terms and Conditions (“Terms”) govern your access to and use of the Directory, including any content, functionality, and services offered on or through the Directory (collectively, the “Service”).
Please read the Terms carefully before using the Service. By accessing or using the Service, you agree to be bound by these Terms and any applicable laws and regulations. If you disagree with any part of these Terms, then you may not access or use the Service.
1. Definitions
- User: An individual or entity that accesses or uses the Service.
- Listing: An entry in the Directory that contains information about a pet business, including its name, contact information, services offered, and other relevant details.
- Free Listing: A basic listing in the Directory with limited features.
- Paid Listing: A listing in the Directory with enhanced features and increased visibility compared to Free Listings.
- Content: Any information, data, text, graphics, photographs, or other materials uploaded, submitted, or displayed on the Directory.
2. User Accounts
- Users may create accounts on the Directory to submit Listings, manage their profiles, and access certain features.
- You are responsible for maintaining the confidentiality of your account information, including your username and password. You are also responsible for all activities that occur under your account.
- You agree to notify us immediately of any unauthorized use of your account or any other security breach.
3. Listings
- Free Listings: Users may submit one Free Listing per business.
- Paid Listings: Users may upgrade their Listings to Paid Listings for additional features and benefits. The specific features and pricing for Paid Listings are available on the Directory website.
- Listing Accuracy: You are responsible for ensuring that the information in your Listing is accurate, complete, and up-to-date. We reserve the right to remove any Listing that we believe to be inaccurate, misleading, or otherwise inappropriate.
- Content Restrictions: Your Listing content must not be:
- False, misleading, or deceptive.
- Infringing on the intellectual property rights of any third party.
- Obscene, defamatory, or hateful.
- Promoting illegal activities or violence.
4. User Content
- You retain all ownership rights to the Content you submit to the Directory.
- By submitting Content, you grant us a non-exclusive, irrevocable, royalty-free worldwide license to use, reproduce, modify, publish, distribute, and translate your Content for the purpose of operating and promoting the Directory.
- You are solely responsible for any Content you submit to the Directory.
5. Disclaimer of Warranties
- The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We disclaim all warranties, including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We do not warrant that the Service will be uninterrupted, secure, or error-free.
- We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable.
6. Limitation of Liability
- We will not be liable for any damages arising out of or related to your use of the Service.
- This includes, but is not limited to, direct, indirect, incidental, consequential, punitive, or special damages.
7. Termination
- We may terminate your access to the Service for any reason, at any time, without notice.
- You may terminate your account at any time.
8. Intellectual Property
- The Service and all content and materials included on the Directory are protected by copyright, trademark, and other intellectual property laws.
- You may not use any content or materials from the Directory without our prior written permission.
9. Governing Law
- These Terms shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions.
10. Dispute Resolution
- Any dispute arising out of or relating to these Terms will be resolved by binding arbitration in accordance with the rules of Arbitrators’ and Mediators’ Institute of New Zealand (https://www.aminz.org.nz/arbitration). The arbitration shall be held in Christchurch, New Zealand.
11. Entire Agreement
- These Terms constitute the entire agreement between you and us regarding your use of the Service.
12. Changes to the Terms
- We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on the Directory.
- You are advised to review the Terms periodically for any changes. Your continued use of the Service after the posting of any revised Terms
13. Credential Verification
- In order to promote trust and reliability within the Directory, pet businesses may be required to submit documentation to verify the accuracy of the information listed in their profile, including, but not limited to, insurance policies, certifications, and licenses.
- We will use commercially reasonable efforts to verify the authenticity and validity of submitted documents.
- Verification methods may include contacting issuing bodies, checking online databases, and reviewing documentation for completeness and accuracy.
14. Disclaimer of Liability
- While we strive to ensure the accuracy of verified credentials, we do not guarantee the absolute validity of any submitted documents. The ultimate responsibility for the accuracy of information on a Listing lies with the pet business itself.
- We will not be held liable for any damages arising from our inability to verify the accuracy of submitted documents or for any errors or omissions in the verification process.
